1. Introduction

These Terms and Conditions ("Terms") govern your use of Ethoseek Software Private Limited ("the Service"), operated by Ethoseek Software Private Limited. By accessing or using the Service, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

2. Account Registration

  • You must create an account to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

4. Payment and Billing

  • All fees are billed in advance on a recurring basis (e.g., monthly or annually) and are non-refundable, except as provided in our Cancellation and Refunds Policy.
  • By providing your payment information, you authorize us to charge your payment method for the applicable fees and any applicable taxes.
  • We reserve the right to change our fees at any time. We will provide notice of fee changes via email or through the Service.

5. Intellectual Property

  • The Service and its original content, features, and functionality are and will remain the exclusive property of Ethoseek Software Private Limited and its licensors.
  • You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the Service.
  • All trademarks, service marks, and trade names are the property of Ethoseek Software Private Limited or its affiliates or licensors.

6. Termination

  • We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
  • Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact our support team.

7. Limitation of Liability

The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

In no event shall Ethoseek Software Private Limited, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • your access to or use of or inability to access or use the Service;
  • any conduct or content of any third party on the Service;
  • any content obtained from the Service; and
  • unauthorized access, use, or alteration of your transmissions or content.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of Pune, India, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the courts of Pune, India.

9. Changes to the Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice before any new terms take effect. What constitutes a material change will be determined at our sole discretion.
